FHWN Attorney Published in Michigan Real Property Review

FHWN Attorney Ross A. Hammersley was recently published in the Michigan Real Property Review, “the official journal of the Real Property Law Section of the State Bar of Michigan.”

Appearing in the Winter 2006 issue, and co-written with Christopher Bzdok, of Olson, Bzdok & Howard, P.C., the article, entitled, Where Will the Water Go? A Snapshot of Recent Changes in Michigan Water Law, 33 Mich Real Prop Rev 214 (2006), is an examination of recent developments in riparian property law, groundwater withdrawal regulations, and regional efforts to protect the waters of the Great Lakes.  These changes will likely impact a broad array of businesses and individuals throughout Michigan, ranging from owners of lake-front or river-front property to farmers, practicing lawyers, legislators, and almost everyone who spends time enjoying the waters throughout our Great Lakes state.  The following is an excerpt from the introduction to the article:

“The past year has seen significant changes in the way Michigan will treat users of the state’s rivers, streams, lakes and groundwater.  These developments have taken the form of: (1) a new common law test for determining what is and is not reasonable use; (2) a new statute to regulate large groundwater withdrawals; and (3) a pair of agreements intended to set boundaries on the use and diversion of water from the Great Lakes basin.  While each of these developments is significant individually, the connections between the three are also important to understanding the larger picture.  What is more, each of these developments is a step in a process that is not yet concluded.”

Mr. Hammersley is a cum laude graduate of the Michigan State College of Law where he served as Editor-in-Chief of the Michigan State Law Review.  He received his Bachelor of Science degree from the School of Natural Resources and Environment at the University of Michigan where he specialized in resource ecology and management.  Prior to entering law school, Mr. Hammersley gained extensive experience in research and development and media outreach with environmental non-profit organizations.
