FHWN Obtains Major Litigation Victory for European Client

On December 17, 2008, FHWN Principal David L. Haron and Attorney Ross A. Hammersley obtained a judgment on behalf of an international client in the amount of $1,200,000, plus costs and sanctions, from the Honorable Shalina Kumar, Judge of the Oakland County Circuit Court.

The case involved a dispute over three check transactions between a French casino, located in Cannes, France, and a wealthy local fertility physician. Mr. Haron succeeded by arguing the applicability of a variety of complex and interrelated sources of law, including French Civil Law, Michigan gambling law, the Uniform Commercial Code and the Hague Convention on International Discovery.

Both Mr. Haron and Mr. Hammersley were also successful in countering numerous motions by the defendant, including repeated motions to dismiss the case or to transfer it to France based on the doctrine of forum non conveniens.
